Scope of Services and Exclusions

These Terms of Service govern the rental of roll-off containers, commercial dumpsters, and portable restrooms provided by USA Container Rentals in Ingleside, TX 78374. Services covered include delivery, placement, pickup, and scheduled servicing of equipment for construction, renovation, event, and ongoing waste management needs. Exclusions apply to hazardous materials regulated by the EPA Resource Conservation and Recovery Act (RCRA), including paints, solvents, chemicals, asbestos, and medical waste. Oversized or overweight loads may require a State DOT permit. Customers are responsible for obtaining any right-of-way permits required by the City of Ingleside for street-placed dumpsters. Portable restroom rentals include weekly servicing per OSHA standard 1926.51 for construction sanitation. Services requiring special access, extended rental periods, or additional equipment like concrete washout containers or handwashing stations must be agreed upon in writing before delivery.

Scheduling, Cancellations, and Changes

Appointments for delivery and pickup are scheduled based on availability and confirmed by phone or email. Cancellations made less than 24 hours before the scheduled delivery window may incur a fee equal to 50% of the rental fee. Same-day cancellations or no-shows are charged the full rental amount. Changes to container size, service type, or rental duration must be approved by USA Container Rentals at least one business day in advance. Emergency or same-day rentals are subject to premium pricing and limited availability. If the City of Ingleside or local fire codes restrict dumpster placement near buildings or hydrants, the customer must notify us prior to delivery. We reserve the right to reschedule or cancel due to weather, road conditions, or permit issues without penalty.

Pricing Estimates and Payment Terms

Quotes are provided based on the equipment type, rental duration, weight allowance, and disposal fees (tipping fees). All estimates are valid for 14 days unless otherwise stated. Final pricing may adjust if actual weight exceeds the agreed allowance for example, a 30-yard construction dumpster typically holds up to 4 tons of mixed debris. Payment is due at the time of delivery for first-time customers; established commercial accounts may be invoiced net 15. We accept credit cards, checks, and electronic transfers. If the scope changes after delivery (e.g., requesting a larger container or additional portable restrooms), a revised estimate will be provided and must be approved before any changes take effect. Late payments accrue a 1.5% monthly finance charge.

Workmanship Warranty and Equipment Guarantee

USA Container Rentals warrants that all roll-off containers, commercial dumpsters, and portable restrooms delivered are in good working condition and free from defects that affect normal use. Equipment that fails due to manufacturing or service issues within the rental period will be replaced or repaired at no charge. This warranty does not cover damage caused by customer misuse, overloading beyond the weight limit, disposal of prohibited materials (e.g., RCRA-regulated waste), or unauthorized modifications. Any damage to driveways, pavement, or landscaping resulting from normal delivery and pickup is not covered unless caused by gross negligence. Claims must be reported within 24 hours of delivery or occurrence. The warranty is void if equipment is moved or serviced by a third party without our written consent.

Limitation of Liability

USA Container Rentals’ liability for any claim arising from the rental or use of equipment is limited to the total amount paid for the specific service that gave rise to the claim. We are not liable for consequential damages, including lost profits, project delays, or property damage resulting from pre-existing conditions such as weak driveways, underground utilities, or overhead obstructions. Customers assume responsibility for ensuring safe placement of dumpsters and portable restrooms in compliance with local fire codes, OSHA 1926.51, and ADA requirements for events over 200 attendees. We are not responsible for any fines or penalties imposed by the City of Ingleside, State of Texas, or other authorities due to customer failure to obtain necessary permits or follow regulations. This limitation applies to all claims, whether based on contract, tort, or statute.
